Winmind General Terms of Use
These general terms of use apply to all applications and services that can be accessed through websites or solutions operated by Winmind (hereinafter referred to as "Services"). The service-specific special terms define the rules for using the service in more detail, including the use of cookies, data protection, and the scope of use of the Service.
User Definition
- User means any Customer User, person, or company who uses the Service as authorized by the Customer.
- Customer User means a user authorized by the Winmind Customer.
- Customer means an organization that has purchased the right to use Winmind to offer services to its own end customers.
Open Source Software
If the Services contain open source software, then the terms of the open source license may in certain cases take precedence over these terms of use.
Usage Rights
Winmind grants the User a non-exclusive right to use the Services in accordance with this Terms of Use Agreement and the Privacy Policy against the Customer's payment.
When using the Services, you must comply with the following acceptable use restrictions. You must commit to:
(a) Avoid using the Services illegally or for illegal purposes, or in any way that is inconsistent with this Terms of Use Agreement, for example by attempting to hack the Services or adding malicious code (such as viruses);
(b) Not infringe on our intellectual property rights or the rights of other third parties in connection with the use of the Services;
(c) Not post material that is defamatory, offensive, or otherwise questionable in connection with the use of the Services;
(d) Avoid using the Services in a way that could damage, disrupt, overload, or impair our systems or their security;
(e) Not collect data or information about the Services, or attempt to detect data traffic from our servers to which the Services apply.
User Responsibility
The User is responsible for all connections and devices needed to use the Services, their operation, appropriate protection, and related costs.
Winmind's Rights and Obligations
Winmind is constantly developing its Services, which may cause changes to the range and content of the Services. Winmind strives to provide the Services in an up-to-date and continuous manner but is not responsible for interruptions caused, for example, by maintenance work or technical faults. Winmind has the right to suspend the provision of the Services or limit their content without prior notice.
Winmind is not responsible for factual and technical errors in the content, whether these errors were caused by mistake, technical fault, or other reasons. Winmind is not responsible for damage caused to the User or a third party due to incorrect content of the Service or insufficient availability of the Service. The Services have not been developed to meet individual requirements, and when using the Service, you must ensure that the things and functions described in the Service descriptions meet your needs.
When the User notices an error in the content of the Service or detects a technical malfunction in the Service, they should report the error through the Service's feedback channels.
In the Winmind Service, feedback is given via the feedback form on the www.winmind.fi website.
Winmind is not responsible for material produced or published by a third party, which is added by a party using the Service.
Winmind has the right to change the terms of use, appearance, content, or availability of the pages at any time without prior notice and for any reason. Winmind has the right to suspend the provision of the Service during maintenance and update procedures.
Intellectual Property Rights
Ownership and all intellectual property rights to the Service and the text, images, and other material published in the Service belong to Winmind or its partners, including the rights to make changes and pass on the rights.
All rights to the pages and their content are reserved. Publishing, reproducing, transferring, or changing the content or appearance of the pages without the permission of the rights owner is prohibited, except for storing the content on a computer or printing it for personal use or for professional customer guidance.
Feedback and Its Utilization
When you send us feedback, comments, ideas, or suggestions, Winmind has the right to use and utilize them for the development of the Services without any obligation to compensate the User or the Customer. Feedback is given using the feedback form at www.winmind.fi.
In accordance with good practice, the contents of the Service may be quoted for scientific activities and for activities aimed at training social or healthcare professionals to the extent required by the purpose, provided that the source is indicated. Individual information, answers, etc., must not be taken out of context.
The use of the Winmind Service in scientific activities or educational use should be reported to the address: niko.wass@winmind.fi.
Service Data Protection
The processing of personal data related to the Service is described in the Services' privacy statement.
Service Content and Maintenance
The Services are generally available 24 hours a day. However, Winmind has the right to temporarily take the Service out of use due to maintenance, installation, modification work, excessive load on the system, or other similar reasons.
Winmind strives, when reasonably possible, to inform users in advance about interruptions in the Service that are essential for users on Winmind Oy's website or social media channels.
Validity of the Terms of Use and Changes
The terms of use come into force when the User starts using the Service. Winmind may change these terms and conditions at any time by announcing the changes on its website. The new conditions can be found at the bottom of the site.
Applicable Law and Dispute Resolution
Finnish law applies to these terms and any disputes arising from the Service or its content. Any disputes are handled in the Helsinki District Court.
The User undertakes to comply with Finnish law and good practice in all use of the Service in addition to these terms of use.
